Register a live-in relationship under the UCC… Why did the court say this?

In Uttarakhand state, a converted couple has moved the High Court for their protection. Thereafter, the Uttarakhand High Court on a petition filed by live-in intermarriage couples said that if the couples register themselves under the Uniform Civil Code (UCC) within 48 hours, they will be given the necessary protection. The public prosecutor clarified that the junior public prosecutor appearing in the case was not aware that UCC notification was not issued in Uttarakhand. After removing the UCC portion from the court order, a revised order will be issued, the public prosecutor said. A revision petition will be filed for this on Saturday. However, in the meantime, the couple will be protected. The UCC was passed by the Uttarakhand Assembly in February this year in the state of Uttarakhand. Under it there is a provision to enforce uniform law for marriage, property, alimony and inheritance to citizens of all religious communities living in the state. However, registration is mandatory for married and live-in couples. The UCC will come into effect on November 9. The Act has received the assent of both the State Governor and the President and rules are being prepared for its implementation. Chief Minister Pushkar Singh Thami spoke about the implementation of UCC in the state ahead of the State Foundation Day on November 9. A 26-year-old Hindu woman and a 21-year-old Muslim boy had filed a petition in this matter. They are elders and follow different religions but they are afraid of their family members and have sought refuge in the High Court. Citing Section 378 (1) of the Uttarakhand UCC, the public prosecutor said live-in couples in Uttarakhand are required to register information about themselves with the Registrar. The lawyer also said that there is a penalty clause if the relationship is not registered within one month of joining. A bench comprising Justice Manoj Kumar Tiwari and Pankaj Purohit, which heard the petition, said that if the petitioners apply for registration within 48 hours, the head of the police station concerned will provide them with adequate security for 6 weeks. However, in view of the fact that the UCC notification has not been published, a recall petition will be filed on Saturday to make changes in the registration area.
