No chargesheet could be filed in coal smuggling case, trial adjourned
Asansol. No charges were filed in the Asansol special CBI court on Friday in the coal smuggling case. Hence, the trial was adjourned. The next hearing will be held on September 7. Shamsher Hussain, one of the 50 accused named in the charge sheet, could not be produced as he did not appear. Advocate Somnath Chatteraj said his client Shamshar was unwell. The accused, through his lawyer, asked for time to gather some more facts about the bankruptcy of his company, which was granted. The case did not come up for hearing on Friday. Finally, Asansol Special CBI Court Judge Rajesh Chakraborty ordered the next hearing of the case on September 7. Until then, the CBI has been directed to file a chargesheet in the case and the parties involved have been directed to appear in court on the day. The special judge also ordered that the bankruptcy petition of the private company will be heard on the same day. A copy of the charge sheet was given to the lawyers of all the accused named in the charge sheet. It may be noted that during the last hearing, the lawyers had applied on behalf of the accused to obtain copies of the charge sheet under Section 207 CrPC. If the evidence of the special CBI court is to be believed, a total of 49 persons, including Anup Maji alias Lala, the prime accused in the coal smuggling case, appeared before the court today. Two lawyers from the Asansol court, Shekhar Kundu and Somnath Chattaraj, said the charges would be filed on Friday. But this did not happen as there was no one accused. Earlier it was reported that the accused in the case will be sentenced on July 3. But even then it was not possible. The two accused, Tarakeshwar Mandal and Major Shakeel, did not turn up that day.
