During Kejriwal's bail hearing at the Rose Avenue court, the SG said – misleading the court

During this, the Enforcement Directorate's lawyer objected to Kejriwal's bail. ASG Raju started the debate on Kejriwal misleading the court. He said Kejriwal got interim bail only for election campaign. They must surrender on June 2. Nowhere in its earlier order did the Supreme Court say that Arvind can file a petition seeking extension of interim bail. SG Tushar Mehta said that Kejriwal is misleading the court. What arguments did the ASG present? As for regular bail, the ASG said he should remain in custody. He is still out of custody. Kejriwal got interim bail after Supreme Court granted bail. He has sought an extension of the Supreme Court order here. Kejriwal did not get interim bail in Rose Avenue Court, only in Supreme Court, so how can he ask this court to extend interim bail. ASG Raju also argued that the only relief he got from the Supreme Court was that he could approach the lower court for regular bail, but that did not mean he had to start seeking interim bail here. His plea for grant of interim bail for 7 days is not meritorious. Absent facts in Kejriwal's plea, ASG Raju said the dual conditionality of bail under Section 45 of the PMLA applies to interim bail as well. Here too, the court must be satisfied that Kejriwal is not prosecuted before granting bail. The ASG further argued that Aravind in his petition did not mention that he had earlier filed a petition in the Supreme Court in this court but the Registrar General had refused to list it for preliminary hearing. He has hidden this fact from the court. Arvind is actually trying to mislead the court by experimenting by seeking extension of interim bail by 7 days.
